The payslip is short, nobody warned you, and the HR email says only that a court order has been received.

What to know first: An attachment of earnings order is a county court order that makes your employer take money from your wages to pay a CCJ. It cannot be made if your take-home pay is below the protected rate. You can ask the court to suspend or change it using form N244, and the sooner you act the better.

Based on National Debtline. This covers England and Wales. A CCJ is a County Court Judgment, a court order to pay.

How you get here

It follows a CCJ you did not keep up with. National Debtline says a creditor can apply if you are behind on the CCJ payments, you are an employee and you owe more than £50 (National Debtline). If a CCJ is on your mind, read what happens if you ignore a CCJ.

Before it is made, the court sends you the N56 form. Return it within eight days. Not returning it, or giving false information, is an offence (National Debtline). You can ask for the order to be suspended on the N56 itself, giving a reason such as risk to your job. You then pay the creditor directly, and if you miss payments the creditor can ask to restart deductions (National Debtline).

A fee applies unless you qualify for help (National Debtline). Disagree with the terms? You or your creditor have 14 days to tell the court, and a hearing with a District Judge follows. Bring your budget and details of other debts (National Debtline).

A consolidated order has no up-front fee, but the court deducts 10p per £1 paid in while it is running, and only CCJ debts can be included (National Debtline).

What it does not do

It does not appear on your credit file by itself, but the CCJ behind it does, for 6 years from the date it was made (National Debtline). Changing jobs does not cancel it either. The deductions pause and the creditor can use the order again with your new employer (National Debtline).

If other debts are piling up, look at a debt management plan or breathing space. Facing collectors at the door instead? Read whether bailiffs can enter your home and your rights with debt collectors.

What people usually ask next

Who can get an attachment of earnings order?

A creditor with a CCJ against you, if you are behind on the CCJ payments, you are an employee and you owe more than £50 on the judgment (National Debtline). Self-employed people and people on benefits are not covered.

Will my employer take everything?

No. National Debtline says the court cannot make an order if your take-home pay is below the protected rate, a figure calculated from set amounts for essential spending (National Debtline). The guide does not publish the amounts, so ask the court or an adviser.

What is the N56 form?

It is the form the court sends you. National Debtline says to return it within eight days. Not returning it, or giving false information, is an offence (National Debtline).

Can I stop it before it starts?

Possibly. If you have missed CCJ payments but no application has been made, you can apply to vary the payments on form N245, and keeping up with the court-set payments stops most enforcement including this one (National Debtline). A fee applies unless you qualify for help.

Can I stop it once it is in place?

You can apply to suspend it on form N244, or to vary it if you cannot afford the deductions. A fee applies unless you qualify for help (National Debtline).

What if I change jobs?

National Debtline says the deductions stop but the order is not cancelled. A new job lets the creditor use it again, and you must give the court your new employer’s details (National Debtline).

Will it show on my credit file?

The order itself does not, but National Debtline says the CCJ behind it stays for 6 years from the date it was made (National Debtline). See how long a CCJ lasts.

Does my employer charge me?

Your employer can deduct £1 each time they take money from your wages for administration (National Debtline).
