Three months behind on rent, a court date, and now you are lying awake wondering if that is a CCJ and whether it has wrecked your credit file.

What to know first: Often not, at first. A money judgment for rent arrears made in possession proceedings is exempt from the Register of Judgments, Orders and Fines. It should not show on your credit file until the landlord takes a step to enforce it, such as bailiffs or an order on your wages. The debt is still real, though, and enforcement can put it on the register for six years.

Based on Shelter legal guidance and Pump Court Chambers. This covers England and Wales. We found nothing on Scotland, so get local advice there.

Why this is different from an ordinary CCJ

A CCJ is a County Court Judgment, a court order saying you owe money. Normally it goes on a public register that credit companies check. Shelter explains that a money judgment given alongside a possession order is carved out by regulation 9(d) of the Register of Judgments, Orders and Fines Regulations 2005 (Shelter). So the court order exists, but the register entry does not, yet.

Most online guidance skips this. It tells tenants a rent CCJ is on their file, and that is often not the case at the first stage.

When it does get registered

Registration happens when the landlord takes a step to enforce the money. Shelter names a warrant of control (bailiffs), a third party debt order, a charging order and an attachment of earnings order. Evicting you with a warrant of possession is not one of them, because that recovers the property rather than the money (Shelter).

If your possession order is suspended on terms, the money judgment is suspended too. Break the terms, the landlord enforces, and registration follows (Shelter). Once registered, it normally stays six years (Pump Court Chambers).

What it does not mean

It does not mean the debt has disappeared. Pump Court Chambers puts it plainly: a clean credit file does not mean the arrears are gone (Pump Court Chambers). The landlord can still enforce, and the amount still counts as money you owe.

What to do now

  • Pay the arrears on the agreed schedule if there is one. That is the best way to keep it off the register.
  • If you cannot keep to it, speak to the court and the landlord early, and call StepChange on 0800 138 1111.
  • Know how interest can grow the rest of your debts with the minimum payment trap calculator.
  • Read what happens if you ignore a CCJ if you have other court papers.
  • Put your whole list of debts in the free payoff planner so rent does not crowd out other bills.

Before you panic, read these

The court gave a money judgment for my rent. Is that on my credit file?

Shelter’s legal guidance says a money judgment made in possession proceedings is exempt from the Register of Judgments, Orders and Fines, so it should not appear on a credit file until the landlord takes a step to enforce it (Shelter).

What counts as enforcing it?

Shelter lists a warrant of control, a third party debt order, a charging order and an attachment of earnings order. A warrant of possession does not count, because it recovers the home rather than the money (Shelter). See attachment of earnings orders.

So the debt has gone away?

No. A clean credit file does not mean the arrears are gone. The order still exists and can be enforced (Pump Court Chambers). Treat it as a live debt.

What if my possession order is suspended and I keep to the payments?

Shelter says the money judgment is suspended on the same terms. If you break them and the landlord enforces, registration follows (Shelter). That is why keeping to the schedule matters.

What happens once it is registered?

A registered judgment normally stays on the register for six years. Paid within one month it can be removed. Paid later it stays but is marked satisfied (Pump Court Chambers). See how long a CCJ lasts.

Can a landlord get a money judgment through the accelerated possession route?

No. Shelter notes a money judgment cannot be requested in the accelerated procedure for assured shorthold tenancies, so a landlord wanting an arrears judgment may need the standard route (Shelter).

I got a letter from a bailiff about rent. What now?

That suggests enforcement may have started. Do not ignore it. Read can bailiffs enter my home and your rights with collectors, then call StepChange on 0800 138 1111.
